Accordingly, Ms Burdan had her license to ride in races suspended for a period to commence after racing on 13 July and conclude after racing on 24 July 2019.
Facts:
Following the running of race 2, Mullholland For A Stronger Voice, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Ms Burdan allowed her mount SHOWCAT to shift in when not sufficiently clear of DONTGIVEADAM which was forced inwards crowding MEKELLE which was checked near the 900 metres.
Ms Burdan said that she understood the Rule and confirmed her admission of the breach.
Mr N Harris assisted Ms Burdan at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Jones demonstrated the incident using the available video footage. He identified that Ms Burdan was racing in a 4 wide position near the 900 metres when she allowed her mount to shift in. In doing so SHOWCAT (Ms Burdan) was a bare length clear of DONTGIVEADAM which was forced inwards and crowded MEKELLE which was checked.
Ms Burdan said that she accepted Mr Jones’ interpretation of the incident and had nothing to add.
Mr Harris said that Ms Burdan needs to learn to give her fellow riders some extra room when crossing another horse. He said that Mr Kareem, the rider of DONTGIVEADAM, and Ms Burdan were still learning their trade.
Submissions for Penalty:
Mr Coles said that Ms Burdan has had 65 raceday rides to date with 1 suspension for careless riding. He described the level of carelessness as low and in mitigation Ms Burdan admitted the breach. Mr Coles submitted that a suspension in line with that would be appropriate.
Ms Burdan advised that she had spoken to her employer Mr J Richards. He said that Ms Burdan had commitments at Wellington on 13 July and any proposed suspension could start after that date.
Mr Harris had nothing to add.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented.
When reviewing the video footage the Committee found that Ms Burdan permitted her mount to shift in 1 horse width when only 1 length clear of DONTGIVEADAM. As a result that runner was forced inwards on the point of the bend near the 900 metres and MIKELLE was crowded and checked. The Committee deemed the level of carelessness displayed by Ms Burdan was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 national riding days which was adopted.
There were no aggravating factors that warranted an uplift in penalty.
The mitigating factors were Ms Burdan’s admission of the breach and relatively good record. For these collective factors Ms Burdan was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
