As Ms Spratt admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Ms Spratt’s suspension pursuant to Rule 1106(2).

Accordingly, Ms Spratt had her license to ride in races suspended for a period to commence after racing on 7 November and conclude after racing on 12 November 2017 (5 National riding days)


 

Facts:

Following the running of race 5, www.westbrook.co.nz 1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that near the 900 metres Ms Spratt allowed her mount MORRIE OCK to shift in when not sufficiently clear of PEACEFUL FALLS which was crowded and hampered for a distance.

Ms Spratt acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson demonstrated the incident using the available video footage. He identified that Ms Spratt allowed her mount to shift in 1 horse width when only a bare length clear of PEACEFUL FALLS. He said this resulted in that runner losing ½ a length when crowded and placed in restricted room for about 50 metres.

Ms Spratt admitted that she crossed over into the line of PEACEFUL FALLS when not sufficiently clear. She said that she misjudged her inward shift.

Submissions for Penalty:

Mr Coles produced Ms Spratt’s record which showed 2 previous breaches under this Rule in the last 12 months, the most recent being 25 January 2017 which incurred a 4 day suspension. He said that Ms Spratt had a reasonably good record, the level of carelessness was low end and submitted a penalty in line with that.

Ms Spratt advised that she had upcoming engagements at Ellerslie on 7 November and sought a deferment to any proposed suspension.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

With effect from 1 November 2017 penalties for careless riding breaches will be determined according to a National riding day formula.

When reviewing the video footage the Committee observed that Ms Spratt allowed her mount to gradually shift in 1 horse width when only a bare length clear of PEACEFUL FALLS. As a consequence of that shift Ms A Collett was required to take a firm hold of her mount when crowded for a short distance. The video footage showed that the incident cost PEACEFUL FALLS ½ a length. The Committee deemed the carelessness displayed by Ms Spratt was low range.

The Penalty Guide for Judicial Committees starting point for low range carelessness is 6 National riding days.

There were no aggravating factors.

The mitigating factors were Ms Spratt’s admission of the breach and her good record. For these collective factors a 1 day reduction was applied.

After taking into account all the above factors the Committee considered an appropriate suspension was 5 National riding days.
