In Race 8 the Jans TAB Ponsonby "1600" under Rule 876 (1) an information instigating a protest was lodged by Mr S Cameron, trainer of SCOTTISH MOON, ridden by Michael Walker, placed fourth against MANACOURT

In Race 8 the Jans TAB Ponsonby "1600" under Rule 876 (1) an information instigating a protest was lodged by Mr S Cameron, trainer of SCOTTISH MOON, ridden by Michael Walker, placed fourth against MANACOURT, trained by Mr J Trumper, placed second and ridden by apprentice Tasha Collett, alleging interference in the final straight.

SCOTTISH MOON was represented by trainer Mr S Cameron and MANACOURT by trainer Mr J Trumper. Margins at the finish were a half length between first and second, two and a half lengths between second and third, and half a length between third and fourth.

Mr Cameron stated that SCOTTISH MOON, approximately 450 metres out from the finish, was improving between two horses and was checked on the inside by MANACOURT who moved outwards. This cost SCOTTISH MOON one to two lengths and this prevented SCOTTISH MOON from finishing third.

Mr Cameron demonstrated on the head-on film of the incident and the effect of two horses checking SCOTTISH MOON who finished half a length from the third horse RUMOURHAZIT at the line. Mr Walker stated that the outside horse AROSE who eventually finished first had also been involved in the incident and that there was a check to his horse.

Mr Trumper admitted that interference had occurred but contended that this had mainly been caused by the outside horse AROSE.

Stipendiary Steward Mr A Coles noted the contribution of the winner AROSE on the outside to the incident and the progress from well back of the third placed horse RUMOURHAZIT who ran on well.

The judicial panel considered that interference occurred to SCOTTISH MOON when making a forward move at the 450 metre mark and this was caused by MANACOURT on the inside and AROSE on the outside. However, taking into account the contribution of AROSE on the outside who made contact with SCOTTISH MOON as well as outward movement of MANACOURT and the finishing on from well back of the third horse RUMOURHAZIT, the judicial panel exercised its discretion not to relegate MANACOURT behind SCOTTISH MOON.

The protest was dismissed and the judicial panel ordered that the protest deposit be refunded.
