--This is an information filed by Stipendiary Steward Mr J. Muirhead against Mr T. Macfarlane driver of CHARDANAE alleging a breach of the above rule in that he drove in a manner likely to and which did cause interference to RIVER GLIDE driven by Mr G. Robb at the winning post.
--Mr Macfarlane admitted the breach and was present at the hearing.
--Mr Muirhead showed the video film of the incident. At the winning post Mr Macfarlane moved his horse inwards and tightened RIVER GLIDE which broke.
--Mr Macfarlane said that he was committed to the run he took and that the narrowing of the passing lane had an effect on the situation.
--Penalty:
--Mr Muirhead said that Mr Macfarlane had no breaches of the rules recorded against him in the last 12 months and that the offending was mid to lower on the scale of seriousness. He recommends a fine of $250.00.
--Mr Macfarlane accepts the recommendation.
--In fixing penalty the committee takes into account the guilty plea, the excellent driving record of Mr Macfarlane, the submissions of Mr Muirhead and the acceptance of them by Mr Macfarlane, the recommended starting point in the penalty guide of a fine of $600.00 and/or three weeks suspension (this was a Group One race), the fact that the chances of other horses were not affected and also that this breach occurred when the race was over. The committee accepts the offending was in the lower half of the scale of seriousness. Balancing those matters, but with particular emphasis on the excellent driving record and the fact that the race was effectively over, a fine of $250.00 is imposed.
