Facts:

Following the running of the PEGASUS SPUR STANDING AT WOODLANDS STUD HANDICAP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 5th placing of ACE MOMENT on the grounds that it broke near the 400 metres mark and galloped in excess of 150 metres.

Mr B Hackett the Co-Trainer of ACE MOMENT was not present at the Hearing but he endorsed the Information with the words " I do not contest the Protest ".

Rule 870(3) provides: "that if a horse breaks from its gait during a race it shall promptly regain its correct gait. "

The Breaking Horse Regulations provide: "that if a horse breaks from its gait during a race and gallops for 150 metres or more the it shall be in breach of Rule 870(3)."

Mr Mulcay demonstrated the incident by use of the race films and showed where ACE MOMENT broke and it continued in a gallop for close to 200 metres.

Submissions for Decision:

Mr Mulcay said that because ACE MOMENT had galloped so far it was in breach of the Rule and should be disqualified from the race.
