Facts:
An Information Instigating a Protest was lodged by Stipendiary Steward Mr NG McIntyre against the 3rd placing of horse number 11 FRANCO NATTAI on the grounds that it galloped excessively inside the last 200 metres of the Race.
Mr M Purdon the Driver of FRANCO NATTAI endorsed the Information with the words " I do not contest the Protest ".
Mr McIntyre demonstrated the incident by use of the video films and he showed where FRANCO NATTAI broke in the home straight and galloped for about 100 metres.
Submissions for Decision:
Mr McIntyre submitted that because FRANCO NATTAI galloped in excess of 50 metres then it was in breach of the Breaking Horses Regulations and also Rule 870(3).
