| -- Mr Day you have admitted breaches of Rules 864(2)(e) and 305(b) in that you failed to activate the Pull Down Blinds on CAMLACH and failed to report to a Stipendiary Steward your failure to do so as soon as practicable. --In determining the appropriate penalty we take into account your admission of the breaches of the Rules and your clear record with respect to similar Rules in Australia. We note pursuant to Rule 1114(2) that this was an Interdominion Heat. We accept your statement that you had not received the Interdominion Guide and that you were confused as to the operation of these particular rules. We give you the benefit of the doubt and accept this lessens your degree of culpability. We agree with Mr Muirhead that the breaches can be dealt with on a totality basis, with just one penalty. We fine you the sum of $150.00 and strongly recommend you become familiar with your obligations under the Rules of New Zealand Harness Racing. |
