Mr Lang admitted a breach of Rule 867 in that in Race 4 he drove the horse JAGGED ACCOUNT with his left foot out of the sulky foot rest making contact with the horse's near hind leg in the run home. Mr Muirhead, Stipendiary Steward, submitted that Mr Lang had made contact with the horse's leg on three occasions. Mr Lang stated he was not aware contact was made, and if he did, it was accidental.

In determining penalty, we give weight to Mr Lang's ready admission of the breach, but balanced against this is the fact that he has been both cautioned and fined the sum of $100.00 for breaches of a similar rule in Australia this season. In finding this to be towards the upper end of the scale of seriousness for a breach of Rule 867, we note that Mr Lang held his foot out forward using it as a bar. The video evidence supported Mr Muirhead's submission that contact was made by Mr Lang's left foot with the near hind leg of the horse on three occasions. Finally, we have regard to Rule 1114 (2) that this was an Interdominion Heat, the stake for 1st was $20,000, and the need to maintain the integrity of the Rules of Harness Racing, and in this regard we observe that the horse was clear of the field and that Mr Lang's actions would have been obvious to the racing public.

Taking all these matters into account, we fine Mr Lang the sum of $750.00.
