Facts:
Following the running of Race 3, the Wish for Fish Annual Fundraiser July 20 Trot 2200m, Mr Muirhead instigated a protest against the 4th placing of the horse BEG FOR CHEVRON. Mr Muirhead alleged that BEG FOR CHEVRON broke near the 180m and failed to settle thereby galloping in excess of 50m in the final 200m.
Mr S Phelan, driver of the horse BEG FOR CHEVRON and representing the connections of the horse was not present at the hearing, however he had noted on the Information that he did not contest the protest.
Rule 870 (3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horse Regulations (b) provide that 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait'.

Using the available films Mr Muirhead pointed out that BEG FOR CHEVRON had been in behind the leading horses early in the home run when the driver angled it towards the passing lane. At about the 180m mark the horse went off stride and galloped to the finish in 4th placing. Mr Muirhead submitted that the horse should therefore be disqualified from the race.
Reasons for Decision:
The protest was not contested. The films clearly showed that BEG FOR CHEVRON had galloped for at least 180 metres within the final 200 metres of the race.
