The Committee therefore disqualified MASTER MERLIN from its 5th placing (for which there was prizemoney).

Facts:
Following the running of Race 9, the NEW YEARS EVE AUCKLAND CUP TWILIGHT RACES TROT 2200m, an Information instigating a protest was produced by Mr Muirhead, He alleged that MASTER MERLIN broke in excess of 50m in the final 200m of the race. The Information was signed by Ms Donnelly who added that (a) the breach was admitted, and (b) she did not contest the Protest.
Rule 870(3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horses Regulations (b) state 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.
The Judges placings were :

Using the films Mr Muirhead identified MASTER MERLIN as the horse approached the 150 metre marker at the finishing point of the race. Just past that point, with about 120 metres to run, MASTER MERLIN went into a gallop and continued to gallop to the finsh of the race, finishing in 5th place. Mr Muirhead said that the horse had breached the Rules and Regulations applicable and asked that the Committee disqualify it from the race. The trainer/driver of the horse (Ms Donnelly) did not contest the protest.
Reasons for Decision:
It was apparent from the films and submissions that the horse MASTER MERLIN had breached Rule 870(3) and the Breaking Horses Regulations.
