--Mr Balle admitted the breach and did not wish to be present at the hearing. He had endorsed the information “a small metal clip broke”.
--Mr Van said the facts were as alleged in the information and he accepted the explanation of Mr Balle. Mr Van Kan said the recommended starting point was a fine of $250.00 but because of the very minor nature of the breach he recommended a fine of $100.00. The facts as presented indicated a breach of Rule 864 (2) (b) in that the gear was not of good quality. The recommended penalty starting point for a breach of that rule is $175.00. In fixing penalty I take into account the following :
--1. The guilty plea.
--2. The minor nature of the breach.
--3. This was probably a breach of Rule 864 (2) (b).
--4. No relevant breaches of the Rules are recorded against Mr Balle.

Balancing those matters I impose a fine of $100.00
