An information was the informant was Mr J M Muirhead and the defendant Mr M White (Jr, Horseman), the information alleged a breach of rule 869(3)(b), careless driving.

An information was the informant was Mr J M Muirhead and the defendant Mr M White (Jr, Horseman), the information alleged a breach of rule 869(3)(b), careless driving.

Mr White admitted the breach of this rule and was present at the hearing of this information, also present was senior horseman Mr J P Stormont to assist Mr White.

The information stated that Junior horseman M White drove Oden Home carelessly, causing a check to Mischievious Mate (Miss A Mathews), racing into the first bend. Mischievious Mate broke losing approximately 3 lenghts.

Mr Muirhead showed the video of race No 4, and this showed over the early stages of this race as the field raced around the first bend. Mr White driving Oden Home was observed to come inwards, Oden Home was running in with its head turned and clipped the front legs of Mischievous Mate. Mr Muirhead stated this incident was at the lower end of careless.

Submissions were heard on penalty from Mr Muirhead and Mr White . The driving record of Mr White was produced for perusal and this record was relatively clear showing only one breach of the rules and a warning. Mr Stormont also made submissions on Mr White's behalf as to penalty.

Decision And Reasons.

This judicial Committee having taken into account the submissions made as to penalty by Mr Muirhead, Mr White and Mr Stormont on behalf of Mr White. The Judicial Committee also acknowledges the breach was at the lower end of the scale. Mr White admitted the breach of the rules which we have taken account of in fixing penalty. Given all of these factors we therefore impose a monetary penalty of a fine of $200.00 in this instance.
