Facts:
After the running of the DUNSTAN FEEDS F&M MOBILE TROT an Information Instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 4th placing of I GOT RHYTHM on the grounds that it galloped in excess of 150 metres in the early stages of the Race.
Mr M McKendry the Driver of I GOT RHYTHM endorsed the Information with the words " I do not contest the Protest ".
Assistant Stipendiary Steward Ms P Kinsey demonstrated the incident by use of the available race films and showed I GOT RHYTHM breaking in the early part of the race and she estimated that it continued in a break for about 180 metres.
Submissions for Decision:
Ms Kinsey submitted that I GOT RHYTHM having galloped in excess of 150 metres was therefore in breach of Rule 870 and the Breaking Horse regulations and should therefore be disqualified from the race.
