The Protest is not contested and accordingly is upheld. WYNBERG SALLY is relegated from 3rd to 4th and DESTINATION MOON is promoted to 3rd.

The amended placings are now: First (4) DOUBLEODEANO

                                                  Third (6) DESTINATION MOON

                                                  Fourth (1) WYNBERG SALLY

                                                  Fifth (11) RANFURY RULZ.

It is ordered that Dividends and Stakes be paid in accordance with the amended placings.

Facts:

Following the running of Race 2 the NEW ZEALAND HERALD MOBILE PACE an Information Instigating a Protest was lodged by Co Chief Stipendiary Steward Mr NG McIntyre against the 3rd placing of WYNBERG SALLY (Driver JP Stormont) on the grounds of breaking at the 1400 metres mark and causing interference to the fourth placed DESTINATION MOON (Driver JI Dickie).

Mr Stormont was present at the Hearing together with Mr WN Hickey the Owner of WYNBERG SALLY and Mr JI Dickie the Driver of DESTINATION MOON.

The relevant Rules were read out and the parties acknowledged that they understood them.

Mr Stormont advised the Committee that the Protest was contested.

Mr McIntyre demonstrated the incident by use of the Race Films and showed that at about the 1400 metres mark WYNBERG SALLY jumped a shadow on the track and broke and in doing so it caused interference to a number of following horses. One of those was DESTINATION MOON which was pushed out 3 wide and then had to move up and sit parked and it eventually ran 4th only half a neck behind WYNBERG SALLY which had recovered and ran 3rd.

Mr Dickie said that at the time his horse had cover and it was his intention to stay there. He said that as a result of WYNBERG SALLY breaking his horse ended up being pushed 3 wide and he had no option but to move forward and sit parked and that affected his horse's chances.

Mr Stormont after hearing the evidence asked to watch the Race Films again and in particular he wanted to watch the Films right to the end of the Race. After viewing the Films and consulting with Mr Hickey he advised the Committee that the Protest was not contested.
