The informant was Mr.J.M.Muirhead and this was a protest by horse No.4 Pickupstix ( Mr. C.Briskie) placed 10th by the judge against horse No.1 River Valley Sun ( Mr.D.Butcher) placed first by the judge.

An information was filed following race No.3 instigating a protest.

The informant was Mr.J.M.Muirhead and this was a protest by horse No.4 Pickupstix ( Mr. C.Briskie) placed 10th by the judge against horse No.1 River Valley Sun ( Mr.D.Butcher) placed first by the judge.

--

This protest alleged interference by River Valley Sun to Pickupstix shortly after the start.

--

The judges placing for this race were 1st No 1, 2nd No 12, 3rd No 5, 4th No 10, 5th No 8, 6th No 9.

Present at the hearing of this protest were Mr.Butcher driver of River Valley Sun, Mr.G.Small trainer of River Valley Sun also representing the owners of this horse and Mr. C. Briskie the driver of Pickupstix.

Mr Muirhead read the rule and its subclauses (4) & (8)

--

Mr Muirhead opened his case by stating that from his vantage point he saw River Valley Sun which had drawn 1 get his head around and lugging out as the field left the mobile barrier.

--

Mr. Muirhead stated he saw Pickupstix break and in his opinion River Valley Sun had caused Pickupstix to break by moving out on this runner.

--

Mr Muirhead showed the video of this incident and this confirmed that River Valley Sun did have its head around and did come out slightly. Mr. Muirhead also alluded to the horse on the outside of Pickupstix which was Sierra Roydon (Mr.A.G.Herlihy) having moved in also at this point of the race.

Mr.D.Butcher in evidence did not deny that his horse had come out slightly however he argued that it was fifty fifty. Mr Butcher was of the opinion that Sierra Roydon on the outside of Pickupstix was the cause of Pickupstix breaking.

Mr Briskie Also stated that it was a fifty fifty call he stated that his chances were affected and his horse broke and lost its position.

Mr Small was of the opinion that Sierra Roydon was the major cause of Pickupstix breaking and he argued that the video showed this to be so. Mr. Small did not deny that River Valley Sun had moved out slightly

Decision And Reasons.

--

Having taken into account all of the evidence produced it is my finding that there was movement outwards from River Valley Sun however the video is clear that Sierra Roydon came in also and did get under Pickupstix. It is my finding that the sulky wheel of this runner did strike the legs of

--

Pickupstix and this was the major factor in the cause of Pickupstix breaking from its gait.

--

There was no evidence to suggest that River Valley Sun has forced Pickupstix onto Sierra Roydon.

--

I therefore dismiss this protest and order that the judges placings shall stand.
