This is an information instigating a protest filed by Stipendiary Steward Mr J. Muirhead against SHEBAR SPIDER driven by Mr M. McKendry and placed 4th by the Judge on the grounds that the horse broke free of interference 70m from the finishing line and galloped for the rest of the race. 



This is an information instigating a protest filed by Stipendiary Steward Mr J. Muirhead against SHEBAR SPIDER driven by Mr M. McKendry and placed 4th by the Judge on the grounds that the horse broke free of interference 70m from the finishing line and galloped for the rest of the race.  Mr I. Moody, trainer and part owner of the horse, endorsed the information ‘I do not contest protest’.  Mr Muirhead said SHEBAR SPIDER was vying for the lead at the 70m mark and was under pressure and at that stage broke free of interference and galloped for the rest of the race.  At the finishing line it was lapped on by two other runners.  Mr Muirhead submitted that in accordance with the Breaking Horses Regulation, SHEBAR SPIDER should be disqualified.

Decision and Reasons:

This is a clear cut case of a breach of the Breaking Horses Regulation. Where a horse is in a break for 50m or more in the last 200m, the Regulation requires the horse to be either relegated or disqualified. The protest is not contested.  In accordance with the usual practice in these circumstances,  SHEBAR SPIDER is disqualified.  The amended placings then being:

1st – IMATROTNOVSKY
2nd – MALABAR MAHAL
3rd – CHARLES DE CAZANOVE
4th – PHOEBE GLADIATOR
5th – FLEX
6th – SPRINGFIELD NOVA
