Mr Van Kan said this was the defendants third breach of this rule since September 2010. He submitted that a fine of $200 was appropriate.

Mr Gillies stated that it was an oversight and that a fine of this amount appeared excessive.
 

Reasons for Penalty:

We have looked at penalties imposed in comparable cases and note these are in the range of $100 to $125. We believe that as this is the third breach of this rule within a period of 7 months that a fine at the top end of this range is appropriate.
