Decision:

An information instigating a protest filed by Stipendiary Steward Mr J Muirhead against ChANGEOVER driven by Mr D Butcher and placed 3rd by the judge on the grounds of an alleged breach of Rule 869 (7) (b) – namely that the sulky wheel of CHANGEOVER moved inside the track marker line for more than 30m in the last 600m of the race. 



An information instigating a protest filed by Stipendiary Steward Mr J Muirhead against CHANGEOVER driven by Mr D Butcher and placed 3rd by the judge on the grounds of an alleged breach of Rule 869 (7) (b) – namely that the sulky wheel of CHANGEOVER moved inside the track marker line for more than 30m in the last 600m of the race. 
Mr R Carr, Syndicate Manager, and Mr D Butcher represented the connections of CHANGEOVER.

Mr Muirhead showed the video film of the incident.  About 300m from the finish CHANGEOVER was hanging badly and its sulky wheel went inside five track markers.  That means there were four gaps between those track markers and each of those gaps is 10m.  The sulky wheel was therefore inside the track markers for 40m.  Neither Mr Carr nor Mr Butcher disputed that evidence.  Mr Butcher was at pains to emphasise that the horse was hanging very badly.  The rule states that where a breach occurs the horse SHALL be disqualified.

Decision :
The evidence presented by Mr Muirhead was clear cut and not contested.  There was a clear breach of the rule and disqualification is mandatory.  CHANGEOVER is therefore disqualified and the final placings are then as follows :
