--My Hay admitted the breach and indicated he did not wish to be present at the hearing.
--Mr Muirhead demonstrated the incident on video showing HOUDINI STAR being driven out to the winning post while being struck with the whip approximately 23 times. Mr Muirhead explained this was clearly excessive in accordance with the guidelines which have been issued, but on the other hand Mr Hay had a very good record and had not previously offended. Weighing up all the circumstances the Stipendiary Stewards recommended that a fine of $200 would be appropriate and the committee accepted this and a fine of $200 was accordingly imposed.
