This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Junior Horseman Mr Z BUTCHER driver of INDULGE alleging a breach of the above rule – careless driving – in that he drove his horse carelessly when moving inwards approximately 150 metres after the start causing interference to ANVIL ON FIRE driven by Mr A BUTT, ANVIL ON FIRE breaking as a result and losing about 10 lengths.

This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Junior Horseman Mr Z BUTCHER driver of INDULGE alleging a breach of the above rule – careless driving – in that he drove his horse carelessly when moving inwards approximately 150 metres after the start causing interference to ANVIL ON FIRE driven by Mr A BUTT, ANVIL ON FIRE breaking as a result and losing about 10 lengths.

Mr BUTCHER admitted the breach and was present at the hearing assisted by Senior Horseman Mr P FERGUSON.  Mr BUTT was also present.

Mr MUIRHEAD said this race was the Great Northern Oaks for 3yr old fillies, a Group 1 race run over the distance of 2700 metres from a mobile start.  He showed the video films of the incident and gave his interpretation of them.  He said LANCOME driven by Mr B ORANGE started from barrier position 1 on the front line, INDULGE outside LANCOME and ANVIL ON FIRE from barrier  position 1 on the second line.  ANVIL ON FIRE did not keep up behind LANCOME after the start and a gap between them developed.  Mr BUTCHER moved INDULGE inwards to get the trail but the front legs of ANVIL ON FIRE were inside Mr BUTCHER’s sulky wheel.  ANVIL ON FIRE was forced over 3 or 4 marker pegs and broke losing about 10 lengths.  Mr MUIRHEAD said Mr BUTCHER’s inexperience in driving in Group races was a factor.  If it was a $10,000 race Mr BUTT would have pulled back, but because it was a Group race he persisted in being there.

Mr BUTT said there was half to three quarters of a gap for Mr BUTCHER.  He called out to him and Mr BUTCHER tried to ease the pressure but there was no room for him to go back out.  He said a lot of horses would not have galloped as ANVIL ON FIRE did.

Mr FERGUSON said the horse drawn 3 on the front line also moved inwards and this did not help.  He demonstrated by use of the video film that INDULGE actually got onto the back of LANCOME but both horses were racing out from the marker pegs.  The incident occurred when INDULGE followed LANCOME inwards.  He said Mr BUTCHER was unlucky and he agreed with Mr MUIRHEAD’s reference to the inexperience factor.

PENALTY

--

Mr MUIRHEAD said the Penalty Guide starting point was a fine of $600 and / or 3 weeks suspension.  He referred to the Group 1 status of the race and Mr BUTCHER’s driving record which has only 1 relevant breach of the rules in the last 12 months.  Mr BUTCHER has had 256 drives so far this season.  He said the offending was in the bottom half on the scale of seriousness.  He suggested a fine slightly under $600.

Mr FERGUSON  accepted the submissions of Mr MUIRHEAD.  He said Mr BUTCHER had pleaded guilty, was a Junior Horseman with an excellent driving record and there was the inexperience factor.

In fixing penalty the committee takes into account the guilty plea, the submissions of Mr MUIRHEAD and Mr FERGUSON, the comments of Mr BUTT, the recommended starting point, Mr BUTCHER’s driving record, the offending being in the lower half on the scale of seriousness, the status of the race, Mr BUTCHER being a Junior Horseman and two relevant previous cases in Group 1 races where fines of $500 and $600 were imposed on Senior Horsemen.  Balancing those matters but with emphasis on the mitigating factors, Mr BUTCHER’s excellent driving record and Junior Horseman status we impose a fine of $400.
