Charge:
The information alleged that “Junior Horsewoman M Teaz drove MINGARA carelessly striking the wheel of the sulky of ITSNOWORNEVER causing her own horse to break from its gait”.
Facts:
This breach arises from race number 2, the Liquor Legends Trot 2200m. Mr J Teaz (Co-trainer of MINGARA) was present at the hearing in support of the Respondent Junior Horsewoman Mrs Teaz.
Mr Muirhead demonstrated the incident to the Judicial Committee (the “Committee”) using side and back-on video footage. He said that at the 180 metre mark in the home straight, Mrs Teaz shifted ground inwards off the back of ITZNOWORNEVER and caused her own horse MINGARA to break.
Mrs Teaz told the Committee that she went to move into a gap but it closed. This caused her to take hold of MINGARA but she acknowledged that it was too late because she had already struck the wheel of ITSNOWORNEVER.
Submissions for Penalty:
Mr Muirhead submitted that the breach was at the low end of the scale in that Mrs Teaz made a mistake which caused her own horse to gallop. He said Mrs Teaz has had 37 drives this season and has a clear record.
Mr J Teaz submitted on behalf of Mrs M Teaz that the breach was minor and the incident cost MINGARA the opportunity to finish the race in a better placing. He said that a $200 fine seemed to be an appropriate penalty for this type of breach.
