The Protest is not contested and is therefore upheld and the Committee orders that GEORGE be disqualified from the race.

The amended placings are now:

first - 5 BLACKGUARDS CORNE

second - 2 WHITNEY

third - 1 TORBJORN

fourth - 4 MONNAY

fifth - 7 SCARRYMCLEARY

It is ordered that dividends and stakes be paid in accordance with the amended placings.

Facts:

Following the running of the BEEHIVE HANDICAP 2016 HANDICAP TROT, an Information instigating a Protest was lodged by Stipendiary Steward, Mr JM Muirhead against the second placing of GEORGE on the grounds that it galloped in excess of 50 metres in the last 200 metres of the Race.

Rule 870(3) provides that any horse which breaks from its gait during a race shall promptly return to its correct gait. The Breaking Horses Regulations provide that any horse which is in a break in excess of 50 metres in the last 200 metres of a race shall be in breach of Rule 870(3).

Mr T MacFarlane the Trainer/Driver of GEORGE advised that he did not contest the Protest and he endorsed the Information with the words " I do not contest disqualification of GEORGE from 2nd" Mr MacFarlane did not wish to be present at the Hearing.

Mr Muirhead demonstrated the incident by use of the race films and showed where GEORGE went into a break more than 100 metres from the finish and continued in a break until the finishing line. This was well in excess of 50 metres.

Submissions for Decision:

Mr Muirhead submitted that GEORGE was in breach of Rule 870(3) and the Breaking Horses Regulations and therefore should be disqualified from the race.
