In accordance with the Rule and Regulations, FIRST CLASS was disqualifed from its 5th place in the race.

The Judges placings are now :

1st  - KRUG

2nd - PLATINUM STRIDE

3rd - BLACK EDITION

4th - CAPTAIN NEMO

Dividends and stakemoney were authorised to be paid in accordance with the Judges placings.

Facts:

Following the running of Race 10, Mr Ydgren instigated a protest in which he alleged that the horse FIRST CLASS, driven by Ms Rasmussen, 'broke in excess of 50 metres in the final 200 metres'.

Ms Rasmussen was present at the hearing and acknowledged that she did not contest the protest, and that she admitted the breach.

Rule 870(3) states 'Any horse which breaks fromt its gait shall promptly regain its proper gait'.

The Breaking Horses Regulations (b) say 'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.

Submissions for Decision:

Using the films Mr Ydgren identified the horse FIRST CLASS as the field entered the final straight. As the field neared the 150 metres point FIRST CLASS which had been trailing the leader went off stride and then galloped to the finish, a distance of approximately 150 metres.

Mr Ydgren stated that the horse was therefore in breach of the Rule and Regulations and asked that it be disqualified from its 5th placing. There were only 5 horses in the field.

Ms Rasmussen had nothing to add.

The Committee observed from the films that FIRST CLASS had indeed gone off stride and galloped for approximately 150 metres, finishing last of the 5 runners.
