Facts:
Following the running of Race 3, Pascoes the Jewellers Handicap Trot 2700, Chief Stipendiary Steward, Mr Ydgren lodged an Information instigating a protest pursuant to Rule 870(3). The particulars of the Information are that: CRUISE ALASKA broke in excess of 50 metres over the final 200 metres.
Mr Richardson, the owner and trainer of CRUISE ALASKA endorsed the Information acknowledging that:
(a) He admitted the breach, and
(b) He did not contest the protest and did not wish to be present at the hearing.
The Judge’s placings were:

Rule 870(3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horses Regulations (b) provide that:
'Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.'.
Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:
(i) relegate the horse per r870(4) or;
(ii) disqualify it per r1003(2)
Submissions for Decision:
Using available race films Mr Ydgren identified CRUISE ALASKA (P Ferguson) who was racing on onside near the marker-line as the field passed the final 200 metres. CRUISE ALASKA was racing in the 5th position when it went off stride and broke into a gallop prior to 150 metre marker. CRUISE ALASKA continued in a gallop for approximately 90 metres. It finished the race in 5th place. Mr Ydgren submitted that the horse was therefore in breach of the Rule 870(3) and Breaking Horse Regulations and should be disqualified from the race.
Reasons for Decision:
After hearing submissions and reviewing the race films it was clear to the Committee that CRUISE ALASKA broke and galloped for at least 90 metres. Accordingly CRUISE ALASKA is in breach of the relevant rule and regulations.
