The Protest is upheld and ALL AMERICAN is disqualified from the race.

The amended placings are now :

first - (4) STRESS FACTOR

second - (1) MUSCULUS

third - (2) JOMO

fourth - (6) MAGNAFIQUE

fifth - (3) SWINGING

It is ordered that dividends and stakes be paid in accordance with the amended placings.

Facts:

Following the running of the CROMBIE LOCKWOOD HANDICAP TROT, an Information Instigating a Protest was lodged by Chief Stipendiary Steward, Mr N Ydgren against the 4th placing of ALL AMERICAN on the grounds that it broke and galloped excessively over the final 100 metres of the race.

Rule 870(3) provides : any horse which breaks from its gait shall promptly regain its proper gait.

The Breaking Horses Regulations in part B provide : Any horse which breaks from its gait within the final 200 metres of any race and continues on in a break for a distance of 50 metres or greater , shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait.

Mr J Dickie the co-Trainer of ALL AMERICAN endorsed the Information with the words "I do not contest the Protest".

Mr Ydgren demonstrated the incident by use of the race films and showed where passing the 100 metres from the finish mark ALL AMERICAN broke and galloped for the remainder of the race.

Submissions for Decision:

Mr Ydgren submitted that because ALL AMERICAN had galloped well in excess of 50 metres in the last 200 metres of the race it was in breach of Rule 870(3) and should be disqualified from the race.
