Decision:
For the above reasons we are not satisfied that Mr Smith caused interference to COLLECTABLE. The charge is dismissed.
Charge:
Drove ANVILS DELIGHT carelessly causing interference to COLLECTABLE driven by Mr M Purdon approximately 250metres after the start.
Facts:
Mr Muirhead gave evidence of his observations of the incident and showed and interpreted the video films of the incident. He said shortly after the start Mr Smith “eased down” COLLECTABLE but did so too quickly. He said Mr Smith then moved his horse further inwards, his sulky wheel went under the belly of COLLECTABLE and hit the hind leg of COLLECTABLE which broke and lost its chance.

Mr Purdon said he had been moved down to the marker line and had no room. He confirmed the contact with the hind leg of COLLECTABLE. In response to questions from Mr Smith he said “it was a fair push-down”, COLLECTABLE was hanging out, had run out and “tends to run out this way round”. In re-examination he said COLLECTABLE had not run out.
To Mr Scott he said COLLECTABLE when hanging out would have been “off set in the cart”.
Mr Smith said he eased down COLLECTABLE slowly and fairly. He said COLLECTABLE was well off the markers when the contact happened – Mr Muirhead conceded that was so. He used the video film to show that COLLECTABLE had turned its head just before the contact, had possibly shied at something, moved outwards and galloped before the contact was made.
Reasons for Decision:
Mr Smith eased down COLLECTABLE in accordance with the Easing Down Regulation. His sulky wheel did not go under the belly of COLLECTABLE. There was contact between Mr Smith’s sulky wheel and the hind leg of COLLECTABLE at the commencement of the turn out of the home straight. COLLECTABLE was hanging out prior to and at the time of the contact. The films do not show precisely how the contact occurred and there is some doubt as to the cause. The most likely reason is that COLLECTABLE did not make the start of the turn as well as it should have done because it was hanging out and off set in the sulky – and thereby in effect moved outwards.
