--This is an information filed by Stipendiary Steward Mr J. Muirhead against Mr G.A. Payne driver of SESHNY BROMAC alleging a breach of the above rule in that he drove his horse carelessly causing interference to CAPS N ART driven by Mr S. Lawson with approximately 600m to run, when improving his horse outwards abruptly.

--This is an information filed by Stipendiary Steward Mr J. Muirhead against Mr G.A. Payne driver of SESHNY BROMAC alleging a breach of the above rule in that he drove his horse carelessly causing interference to CAPS N ART driven by Mr S. Lawson with approximately 600m to run, when improving his horse outwards abruptly.
--Mr Payne admitted the breach and did not wish to be present at the hearing.
--Mr Muirhead showed the video film of the incident. SESHNY BROMAC was racing three wide at the rear of the field and CAPS N ART was on its outside. Mr Payne moved his horse out sharply, made contact with CAPS N ART causing that horse to break.
--Penalty:
--Mr Muirhead said Mr Payne had indicated that he preferred a suspension to a fine. Mr Muirhead said Mr Payne had only had four drives this season and a total of six drives for the whole of last season. Mr Muirhead suggested a suspension of 3 – 4 weeks. He said Mr Payne had been fined $250.00 for a breach of Rule 869(4) on the 11th of December 2009.
--In fixing penalty the committee takes into account the guilty plea, the submissions of Mr Muirhead, the preference of Mr Payne for a suspension, the recent breach of Rule 869(4), this was a race on a premier race day, the offending was mid-range on the scale of seriousness and the infrequency of Mr Payne’s driving. Balancing all of those matters, the committee imposes a fine of $500.00, in particular noting that a suspension would be somewhat meaningless in view of the infrequency with which Mr Payne drives.
