Facts:
Following the running of Race 10, The Alex Bar & Eatery-Open 7am Til Late Trot 2200m, an Information was lodged instigating a Protest against the horse Dead Cat Bounce, which finished 5th. Stipendiary Steward Mr C J Allison alleged that the horse had 'broken' in excess of 150 metres over the early stages of the race.
The trainer of Dead Cat Bounce, Mr M Pemberton, was present at the hearing and indicated that he did not wish to contest the Protest.
Submissions for Decision:
Mr Allison identified the horse Dead Cat Bounce at the start of the race on the available video film. It was clear that the horse went off stride shortly after the start and continued galloping for at least 160m. Mr Allison confirmed that the horse had breached the provisions of Rule 870 and the Breaking Horse Regulations and sought the disqualification of the horse.
Reasons for Decision:
The protest was not contested and clearly the Rule and Breaking Horse Regulations were breached.
