Facts:
An Information was lodged by Stipendiary Steward Mr JM Muirhead against the 4th placing of ALTA CHARISMA (Co-Trainer/Driver Mr TA Macfarlane) on the grounds of breaking with about 150 metres to run and continuing in a break to the finishing line.
The Breaking Horse Regulations provide: "that any horse which breaks from its gait in the final 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait."
Mr Macfarlane endorsed the Information with the words " I do not contest the Protest."
Mr Muirhead demonstrated the incident by use of the video films and these showed ALTA CHARISMA on the running line in the home straight and breaking with approximately 150 metres to run and continuing in a break up to and past the finishing line.
