Facts:
Following the running of the FATHER'S DAY IN THE ALEX BAR & EATERY HCP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr S Mulcay against the 5th placing of REGAL PETITE on the grounds that it galloped in excess of 150 metres over the initial part of the race. REGAL PETITE had been promoted to 5th placing consequent upon the disqualification of DJOKOVIC at a previous Protest.
Mrs PS Screen the part Owner and Trainer of REGAL PETITE endorsed the Information " I do not contest the Protest " and she also elected not to be present at the Hearing.
Part (a) of the Breaking Horse Regulations provides: that any horse which breaks from its gait either at the start or during the running of any race and continues in a break for a distance of 150 metres or greater shall be deemed to be in breach of Rule 870(3) and may be either relegated or disqualified from the race.
Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films and showed where REGAL PETITE broke in the early stages of the race and galloped in excess of 150 metres.
