An information was lodged by Stipendary Steward Mr J Muirhead against Mr B Lee the driver of Greg Brydon in that he drove his horse carelessly

An information was lodged by Stipendary Steward Mr J Muirhead against Mr B Lee the driver of Greg Brydon in that he drove his horse carelessly with approximately 75 metres to run and caused interference to Hanover DG. Mr Lee admitted the breach and was present at the Hearing. Mr Muirhead demonstrated the incident on video film. Mr Lee was in a trailing position in the run home and he moved out in an endeavour to improve his position. There was insufficient room however and Mr Lee continued with his movement and this caused Hanover DG to break. Mr Muirhead submitted that this was a clear case of interference and noted that it had been acknowledged by Mr Lee. Mr Muirhead suggested that the penalty should be in the $400 - $500 range and he pointed out to the Committee that Mr Lee had been fined $250.00 for a similar offence on the 13th of January 2006.

Mr Lee acknowledged causing interference and pointed out that he was attempting to improve his position but he also acknowledged that he should have taken extra care. Mr Lee also acknowledged that he had been fined on the 13th of January 2006.

Imposing penalty the Committee took into account the following matters:

1. The guilty plea by Mr Lee and his frankness at the Hearing.

--

--

2. The submissions made.

--

--

3. The fact that interference was caused at a vital stage of the race.

--

--

Having taken all those matters into account the Committee imposed a fine of $450.00 on Mr Lee.
