As the breach was admitted we found the charge proved.

Penalty:

The Committee therefore imposed a fine of $200 on Mr Blanchard, representing the training partnership.

Facts:

Following the running of Race 1, the LINCOLN FARMS BLOODSTOCK MOBILE TROT 2200, Mr Muirhead presented an Information alleging that Licensed Trainers P & V Blanchard had presented LUCK OF THE MOMENT to race with removeable deafeners instead of the notified fixed deafeners.

Mr P Blanchard, on behalf of the trainers, noted on the Information that they admitted the breach and did not require to be present at the hearing.

Rule 865(2) provides 'Every horse entered in a totalisator race shall be presented in the assembly area prior to the race in the same notifiable gear as that notified under sub-rule (1).

Mr Muirhead stated that Stipendiary Steward Mr B Van Kan had examined the horse LUCK OF THE MOMENT when it entered the birdcage area prior to Race 1. He identified that the horse was wearing removable deafeners instead of the notified fixed deafeners. Mr Muirhead said that the trainers of the horse were informed of the incorrect gear and were given the opportunity to change them, however had elected to run the horse in the wrong gear.

As the trainers of the horse had already breached this Rule twice in the previous 2 months, this matter was dealt with by way of an Information.

Submissions for Penalty:

Mr Muirhead advised the Committee that the matter of penalty in this instance was for the Committee to determine.

Reasons for Penalty:

The Committee ascertained that in May 2017, another trainer was fined $200 at Alexandra Park after breaching this Rule for the 3rd time within 2 months. The Committee therefore determined that the trainers in this matter should be dealt with in a similar manner.
