The protest was withdrawn. The Committee ordered that dividends be paid in accordance with the judges provisional placings, namely:

1st 7 – Windinherhair
2nd 8 – Selkie
3rd 3 – Angel Delight

Facts:

Following the running of Race 2 an Information Instigating a Protest was lodged by Stipendiary Steward Mr J Muirhead against the 2nd placed horse Selkie (Z Butcher) on the grounds that it was in a break over the finishing line and was lapped on by Angel Delight (D Butcher), placed 3rd.

Mr S Reid, the trainer of Selkie appeared at the hearing on behalf of the connections of Selkie. He advised the Judicial Committee (the “Committee”) that the protest was contested.

Submissions for Decision:

Mr Muirhead submitted that Selkie was contesting the lead with the eventual race winner Windinherhair (J Stormont) over the concluding stages of the race. He said that one stride before the finish line Selkie broke and crossed the line in a break and lapped on Angel Delight (D Butcher).

Mr Muirhead demonstrated the final stages of the race by way of available video footage. He also produced a photo of the finish.

Mr Reid submitted that although Selkie paced roughly shortly before the finish, the horse did not break prior to the winning post.

At this point in the hearing Mr Muirhead conceded that the video footage and photo was unclear as to whether or not Selkie broke prior to the winning post and on that basis he withdrew the protest.
