Mr Robb admitted the breach and was present at the hearing. Mr Muirhead demonstrated the incident by use of the video film. It was clear that Mr Robb started the horse from about barrier position five. Mr Robb said the horse gets fractious if standing by itself and also the start had been delayed by Mr Herlihy's horse. Mr Robb suggested the horse should be taken off the unruly for standing starts. PENALTY: Mr Muirhead said Mr Robb had a clear driving record. He said the recommended starting point for penalty was a fine of $400. He suggested a fine below that level would be appropriate. Mr Robb said that he would prefer a fine less than the recommended starting point.
