The Protest having been upheld INKYROE is therefore disqualified from the race.

The amended placings are now : first      (12) HOT CHOCOLATE TART

                                                   fourth   (8)  SAINT MICHEL

                                                   fifth      (13) FRANCO NADAL

It is ordered that dividends and stakes are paid in accordance with the amended placings.

Facts:

Following the running of the MCGREGOR BAILEY CHARTERED ACCOUNTANTS HCP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 3rd placing of INKYROE on the ground that it galloped for the last 250 metres of the race and by failing to regain its gait it was in breach of the Breaking Horses Regulations.

Rule 870(3) provides: "that any horse that breaks from its gait shall promptly regain its proper gait."

The Breaking Horses Regulations provide: "that any horse which is in a break for further than 50 metres in the last 200 metres of any race shall be in breach of Rule 870(3)."

Mr D McGowan the co-Trainer of INKYROE endorsed the Information with the words "I do not contest the Protest."

Submissions for Decision:

Mr Muirhead demonstrated the incident by use of the race films and showed where INKYROE broke on the turn and galloped for the last 250 metres.

Mr Muirhead said that as INKYROE had galloped in excess of 50 metres in the run home it was in breach of Rule 870(3) and should be disqualified from the race.

Reasons for Decision:

The Protest is not contested and is therefore upheld.
