Decision:
Following Race 6 an information was filed by Stipendiary Steward Mr J. Muirhead against Horseman Mr S. Doody under Rule 869(4) in that he drove BRAIG in a manner which interferes or is likely to interfere with his own horse and or GENIUS (T McFarlane) or its progress when jostling for a position on SOVEREIGNTY back between the 1300 metres and 700 metres to run.
Following Race 6 an information was filed by Stipendiary Steward Mr J. Muirhead against Horseman Mr S. Doody under Rule 869(4) in that he drove BRAIG in a manner which interferes or is likely to interfere with his own horse and or GENIUS (T McFarlane) or its progress when jostling for a position on SOVEREIGNTY back between the 1300 metres and 700 metres to run.
--Mr Doody admitted the breach and was present at the hearing.
Stipendiary Steward Mr Muirhead demonstrated the incident by use of the video films which showed the horse Braig driven by Mr Doody racing in a 3 wide position with no cover contesting for a position on the back of the horse Sovereignty for a period of 600 metres. Mr McFarlane driving Genius was racing on his inner holding an advantage over Mr Doody and retained his rightful running line.
--Mr Doody said he should have pulled out of the incident earlier and admitted he contested the position, for too long.
Penalty Submissions
Mr Muirhead submitted a fine ranging from $250.00 -$500.00 would be appropriate. He said the offending was in the medium range of carelessness and Mr Doody had a good driving record although he had limited drives recently due to a broken leg.
Mr Doody had nothing to say.
--Decision
The Committee assessed the evidence and submissions presented. We took into account the guilty plea, Mr Doody’s good driving record and agreed the offending was mid range; accordingly the Committee imposes a fine of $350.00.
