The Protest is accordingly upheld and BROOKS BELLE is disqualified from 5th place and the race.

The amended placings are now : first (9) MEGAMIND

                                                   second (4) OUR ROSA

                                                   third (3) COOL SON

                                                    fourth (1) PHOEBE GEM

                                                    fifth (2) SAINT MICHEL

The Committee orders that stakes be paid in accordance with the amended placings.

Facts:

Following the running of the THOMPSON AND WILSON FAREWELL RACE MOBILE TROT an Information Instigating a Protest was lodged by Senior Stipendiary Steward Mr S Mulcay against the 5th placing of BROOKS BELLE (Driver J Abernethy) on the grounds that it broke and galloped for the final 150 metres of the Race in breach of the Breaking Horses Regulations.

Rule 870(3) states: any horse which breaks from its gait shall promptly regain its proper gait.

Part B of the Breaking Horses Regulations provides : any horse which breaks from its gait in the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait.

Mr J Abernethy the Trainer/Driver of BROOKS BELLE indicated on the Information that he did not contest the Protest and he did not wish to be present at the Hearing.

Mr Mulcay demonstrated the incident using the race films and showed where in the straight BROOKS BELL broke at about the 150 metres mark and continued in a break up to and past the Finishing Post.

Submissions for Decision:

Mr Mulcay submitted that BROOKS BELLE was in breach of Rule 870(3) and should be disqualified from the race.
