An information was filed alleging a breach of the rules namely Rule 869(2)(a) - Unnecessary use of the whip.
The informant was Mr T.W.Taumanu and the defendant Mr. B. LeeAn information was filed alleging a breach of the rules namely Rule 869(2)(a) - Unnecessary use of the whip.
--The informant was Mr T.W.Taumanu and the defendant Mr B Lee. The information alleged Mr Lee used his whip in an unnecessary manner in the run home on Scorpio Vance.
--Mr. Lee did not admit the breach of this rule and was present at the hearing of this information.
--Mr Taumanu showed the video of the run home of race Number 7 and this showed Mr Lee using his whip on Scorpio Vance in the run home when this runner was in last position and having no hope of filling a stake bearing place.
--Mr.Taumanu stated he was disappointed in Mr.Lee for using his whip in this manner on a beaten runner , Mr.Taumanu said this was unnecessary in this instance.
--Mr.Lee said he had a moral obligation to the owners of this horse and had been told by the trainer to use the whip on this horse.

Decision And Reasons.
--Having watched the video of the run home of this race and listened to the oral evidence as presented it is my finding that Mr.Lee did use his whip in an unnecessary manner on this horse Scorpio Vance in the run home.
--Having heard submissions on penalty from both Mr. Taumanu and Mr. Lee and taken into consideration the driving record of Mr.Lee a fine of $300.00 is imposed on this occasion.
--Mr Lee was advised by the Chairman that any further breaches of this nature would result in a suspension of his horsemans licence.
