An information lodged by Stipendiary Steward Mr J Muirhead against Mr P Nairn, driver of INSPIRE alleging a breach of Rule 869 (2) (c) in that he used his whip outside the confines of his sulky during the run home.

--Mr Nairn admitted the breach and was present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. Mr Nairn used his whip outside the confines of the sulky about 15 times during the run home. Mr Muirhead said Mr Nairn had been fined $200.00 for a breach of the same rule last week. He recommended a fine of $400.00. Mr Nairn said he thought it was a minor infringement and that his whip use was not too different to other drivers and that the breach wasn’t too high on the scale.

--In fixing penalty the Committee takes into account the following matters :
--1. The guilty plea.
--2. The previous breach of the same rule by Mr Nairn.
--3. The submissions of Mr Muirhead.
--4. The submissions of Mr Nairn.
--5. The offending was mid range on the scale of seriousness.
--6. The recommended starting point for a breach of this rule is $200.00.

Balancing those matters the Committee imposes a fine of $350.00 and directed Mr Muirhead that a note be put on Mr Nairn’s driving record that he was advised by the Committee that any further breaches of this Rule would result in a substantial penalty..
