Following Race 7 an Information was filed pursuant to rule 638 (1) (d). The Informant, Mr Coles, alleged that 50 metres after the start Mr L Innes, riding MISS HARVARD, allowed his mount to shift in when not clear of COUNTRY DANE (E Dalley). As a result COUNTRY DANE moved in to the line of LISA LOVE (J Collett) who was severely checked.

--Mr Innes admitted the breach of this rule.
--Mr Williamson demonstrated the video films which showed at a point 50 metres after the start, Mr Innes, riding MISS HAVARD, allow his mount to shift in when not the required distance clear of COUNTRY DANE (E Dalley). Mr Williamson said Mr Innes would have been approximately ½ - ¾ length clear of COUNTRY DANE when moving in. This movement caused crowding which resulted in LISA LOVE being severely checked. Mr Williamson said Mr Parish’s mount down on the inside was over racing which compounded the interference but Mr Innes had moved in before this occurred.
--Mr Innes, while admitting the breach said in his opinion, Mr Collett, riding LISA LOVE could have eased back to avoid most of the interference. He also said Mr Parish had come out contributing to the incident.
--PENALTY SUBMISSIONS
--Mr Coles said LISA LOVE and COUNTRY DANE were both entitled to be where they were and the Committee had to consider the severity of the check to LISA LOVE He produced Mr Innes’ record which showed 4 charges in the last 12 months. He submitted a 5 – 6 day suspension would be appropriate.
--Mr Innes said he had commitments up to and including 26 October 09.
--PENALTY
--The Committee carefully considered all the evidence and submissions. Mitigating factors considered were Mr Innes’ guilty plea and the accentuation of the interferences caused by Mr Parish moving out. However it was clear to the Committee that Mr Innes did not fulfil his obligations to the runners on his inside.
--Taking Mr Innes’ riding record and the above factors into account we impose a suspension on Mr Innes from riding in races to commence after racing on 26 October 09 and conclude after racing on 1 November 2009.
