According JOMO was disqualified from its 4th placing at the finish.

The official placings became:

1st - MAGNAFIQUE

2nd - CAITLIN'S SURPRISE

3rd - LITTLE BRO

4th - BURT MUNRO

5th - SPEEDY LAVROS

Authority was given for dividends and stakemoney to be paid in accordance with the amended placings.

Facts:

Following the running of Race 8, the GARRARDS HORSE & HOUND HANDICAP TROT 2200m, Mr Muirhead instigated a protest against the horse JOMO, alleging that it broke for in excess of 150m entering the first turn.

Mr Robinson, the trainer/driver of JOMO and representing the connections was not present at the hearing, however he had endorsed the Information to the effect that 'I do not contest the protest'.

Rule 870 (3) provides 'Any horse which breaks from its gait shall promptly regain its proper gait'.

The Breaking Horses Regulations state :

(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater , shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

The Judges placings were:

Submissions for Decision:

Referring to the films of the race, Mr Muirhead pointed out that shortly after the start of the race, JOMO had gone off stride and galloped from just short of the winning post, and had continued on in a gallop for at least 220 metres. The horse had recovered well and had run on to finish in 4th place. Mr Muirhead stated that the horse was in breach of Rule 870 (3) and the Breaking Horse Regulations; that the trainer/driver Mr Robinson did not contest the protest; and that the Stewards asked that JOMO be disqualified from the race.

Reasons for Decision:

As the protest was not contested, the Committee upheld it.
