Facts:
Following the running of Race 7, the SMITH & PARTNERS LAWYERS WINTER CUP (HCP PACE) an Information was lodged by Mr Muirhead instigating a protest against the 3rd placed horse - BETTORS POCKET - on the grounds that it interfered with the chances of the 4th placed horse, NEW YEARS JAY while contesting their position in the passing lane in the final straight.
Mr T Cameron, Junior driver, was the driver of BETTORS POCKET and represented the connections of the horse. At the commencement of the hearing Mr Cameron endorsed the information to the effect that 'I do not contest this protest', and signed the information accordingly.
The Judges placings were :

Rule 869A(1)(2) provides that " When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead of the horse that, or whose driver caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with'.
Using the available video films, Mr Muirhead identified the horses concerned as the field turned into the home straight. He identified the horse BETTORS POCKET, driven by Mr Cameron which was behind THOMAS MCBRIDE driven by Mr T Mitchell. Mr D Butcher, driving NEW YEARS JAY elected to pursue a run in the passing lane as he was entitled to do. Mr Muirhead then pointed out Mr Cameron switching BETTORS POCKET to a run inside THOMAS MCBRIDE. In doing so Mr Cameron placed pressure on NEW YEARS JAY inside him which was improving its position in the passing lane. Mr Cameron continued to pressure NEW YEARS JAY which was forced over the markers. Approximately 12 metres from the finishing post the two horses hooked sulky wheels. The pressure on NEW YEARS JAY was such that as the horse neared the finish he was almost 1/2 a body width inside the markers. The margin between 3rd and 4th was a head.
Mr Cameron had nothing to say. Mr Abernethy, assisting Mr Cameron, stated that Mr Muirhead had described the incident accurately.
Mr Butcher had nothing to add.

Mr Muirhead stated that the stewards believed that as the protest was not contested the 3rd and 4th placings should be reversed.
Reasons for Decision:
The Committee was satisfied that BETTORS POCKET caused interference to NEW YEARS JAY and as the protest was not contested it was upheld.
