An Information lodging a Protest was laid by Stipendiary Steward Mr J MUIRHEAD following the running of Race 6 against horse number 6 OUR SUNNY WHIZ PLACED 2ND by the Judge on the grounds that that it broke in excess of 150 metres at the start of the race.

Mr Sefonte Trainer of OUR SUNNY WHIZ  was present for the Hearing.

Mr Muirhead gave evidence supported by Video tapes of the commencement of the race which showed OUR SUNNY WHIZ  break at the standing start and continue in excess of 150 metres before regaining the proper gait.

Mr Sefonte in response admitted his horse had broken from the start but said the driver Mr McKendry felt that the horse had regained is proper gait inside 150 metres of the start. He also said that the front on view did not clearly show Our Sunny Whiz failed to regain it proper gait within the stipulated distance

The video tapes side on view did not assist the enquiry but evidence given by Mr Muirhead of the location

--

of marker posts and surveyed distances satisfied the Panel that Our Sunny Whiz had not regained her proper gait until approximately 180 metres after the start.

Following an adjournment the Panel upheld the protest finding that OUR SUNNY WHIZ had broken from the start of Race 6 and had failed to regain its proper gait within 150 metres in breach of the Breaking Horses Regulations and Rule 870(3).

OUR SUNNY WHIZ  was disqualified in accordance with Rule 1003(2)
