Facts:
Following the running of Race 1, the MITOQ BEST DRESSED AT THE OAKS MARCH 2 MBL TROT 1700m, Mr Mulcay submitted an Information instigating a protest against the (promoted) 4th placing of the horse TRICKY RIC, alleging that the horse had broken in excess of 50 metres in the final 200 metres. By way of clarification at an earlier protest hearing the horse KRATOS which had finished in 3rd placing had been disqualified and TRICKY RIC promoted from 5th to 4th.
Mr J Dickie, trainer of TRICKY RIC noted on the Information that-
(a) He admitted the breach, and
(b) He did not wish to be present at the hearing.
Rule 870(3) states 'Any horse which breaks from its gait shall promptly regain its proper gait'
The Breaking Horses Regulation provide that-
(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait.

Using the available films Mr Mulcay identified TRICKY RIC as the horses entered the final straight. Just prior to the 100 metres mark, Mr Mulcay pointed out that TRICKY RIC went offstride when in 3rd place. The horse continued on in a gallop for approximately 75 metres before regaining its gait. The horse finished in 5th placing. Mr Mulcay submitted that the horse was in breach of Rule 870(3) and the Breaking Horses Regulations and submitted that it therefore be disqualified from the race.
Reasons for Decision:
The Committee was satisfied that TRICKY RIC had galloped for approximately 75 metres with the final 200 metres of the race without regaining its correct gait in breach of the Rule and relevant Regulation.
