Facts:
Following the running of the PEGASUS SPUR TENDER CLOSES 23rd OCT HCP TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr JM Muirhead against the 5th placing of MOMENT OF TRUTH (Trainer Mr D Balle ) on the grounds that it broke in the Home Straight and galloped for the last 100 metres of the race.
The regulations provide that a horse that breaks in the last 200 metres of a race and continues in a break for in excess of 50 metres is deemed not to have promptly returned to its gait as required by Rule 870(3). The Committee may then relegate the horse concerned or disqualify it from the race.
Mr Balle endorsed the Information with the words " I do not contest the Protest " He also elected not to be present at the Hearing.
Mr Muirhead demonstrated the incident by use of the race films and these showed MOMENT OF TRUTH breaking at about the 100 metres mark and continuing in a break until the Winning Post.

Mr Muirhead submitted that MOMENT OF TRUTH having galloped in excess of 50 metres then it was in breach of the Rule and the Regulations and should be disqualified from the race.
