An information lodged by Stipendiary Steward Mr J. Muirhead against Mr A. Grayling driver of PERIGO alleging a breach of the above Rule - Careless Driving - in that Mr Grayling drove PERIGO carelessly with about 2100m to run, striking the sulky wheel of WHAT EVER YOU LIKE, causing PERIGO to break and causing interference to DUA DON, CHAMPAGNAT and GYPSY GLASS. Mr Grayling admitted the breach and was present at the hearing.

Mr Murihead demonstrated the incident by use of the video film. PERIGO was racing hard on the back of the horse immediately in front of it. There was a slight easing of the pace resulting in PERIGO striking the sulky wheel of WHAT EVER YOU LIKE and the subsequent interference to the other horses. Mr Grayling confirmed that there had been a slight easing of the pace and he said that PERIGO was a difficult horse to drive - there might not have been a problem with a different horse.

Mr Muirhead suggested a fine in the vicinity of $250.00 or a two day suspension. He said Mr Grayling had only recently resumed driving after a serious injury. He had been suspended for careless driving in February 2004. Mr Grayling said he preferred a suspension. In imposing penalty the Committee took into account the following matters:

  3. The driving record of Mr Grayling.

  5. The submissions made.
  6. --
  7. The offending was at the lower end of the scale taking into account the mitigating factors referred to.

The Committee imposed a suspension of Mr Grayling's horseman's licence for two days, up to the end of racing on the 4th of November 2004.
