Facts:
This charge arises from the running of race 6, the Sims Pacific Metals South of the Bombay’s Mobile Pace 2200m. The Informant, Senior Stipendiary Steward, Mr J Muirhead, alleged that Mrs Matthews “drove MRS ZIPPY carelessly causing interference to ARTANNE approaching the 1400 metres”.
Mrs Matthews endorsed the information “I do admit the breach of the rule” and “I do not wish to be present at the hearing”.
Rule 868(3) provides that no driver in any race shall drive:
(b) carelessly.
Using available video footage Mr Muirhead demonstrated the incident. He told the Judicial Committee (the ‘Committee’) that as the field approached the 1600 metres MRS ZIPPY (A Matthews) was racing one out and one back with ARTANNE racing on its inside on the marker line. He said that MRS ZIPPY’S head was turned inward slightly as Mrs Matthews was endeavouring to cross ARTANNE to secure a trail behind THE HURRICANE (S Iremonger). Mr Muirhead said Mrs Matthews completed the inward shift near the 1400 metre mark, but in doing so MRS ZIPPY’S sulky made contact the ARTANNE’S front left leg. As a result ARTANNE broke and lost all chance.
Mr Muirhead submitted that the level of carelessness was above mid-range. He said that Stewards were concerned Mrs Matthews was clearly determined to shift in when not clear of ARTANNE evidenced by the fact that the shift occurred over a prolonged distance between the 1600 and 1400 metres.
Submissions for Penalty:
Mr Muirhead advised the Committee that Mrs Matthews has a clear record under the careless driving rule. He said she has had 15 drives this current season with most of them being relatively recently. He added in recent weeks she has averaged one drive per week at northern (Alexandra Park and Cambridge) meetings.
Mr Muirhead reiterated the Stewards view that the level of carelessness was above mid-range and submitted that a 5 day suspension would be appropriate.
Reasons for Penalty:
In assessing penalty the Committee has taken into account the Stewards submissions and we have also considered the JCA Penalty Guidelines as well as recent penalties for similar breaches.
Given that Mrs Matthews elected not to attend the hearing the Committee is unable to assess her interpretation of the incident or take into account any submissions as to penalty on her behalf.
We place the level of carelessness at mid-range. In our assessment although the inward shift was not abrupt, it was a prolonged manoeuvre over a distance of 200 metres commencing at the 1600 metres and concluding near the 1400 metres. The check to ARTANNE was severe and its chances of finishing in a better place were extinguished.
The JCA Penalty Guidelines establish a starting point of $500 or 10 drives. We determined that under the circumstances of this breach a 6 drive starting point was appropriate. We afforded Mrs Matthews a 1 day reduction for her admission of the breach and we treated her good record a neutral factor given her limited number of drives this season.
