An information was filed following the running of race eight, alleging a breach of rule 869 2 (a)
| -- An information was filed following the running of race eight, alleging a breach of rule 869 2 (a) , the defendant was Miss N Thorn and the information alleged that Horsewomen Miss N Thorn used her whip excessively when driving Ballistic Liz out over the concluding stages of the race. --Miss Thorn was present at the hearing and admitted the breach of this rule. --Mr. Van Kan showed the video of the run home and this showed Balistic Liz in the lead as the field swung for home Miss Thorn could be seen to urge her horse with the whip and she was holding her ground in the lead eventually finishing in 2nd place at the winning post. Miss Thorn stated that her foot had slipped out of the stirrup on two occasions due the the seat of her sulky slipping. --Miss Thorn stated in mitigation that she was advised by the trainer to drive this horse out vigorously right to the line as on previous drives on this horse. --Decision And Reasons. --This Judicial Committee have given due consideration to the Mitigating factors as presented By Miss Thorn. We have taken into consideration the admission of the breach of this rule by Miss Thorn and we view this breach at the lower end of the scale. We note that Miss Thorn drove her horse with the whip and also ran the reigns over this horses rump on at least two occasions, we have taken into consideration that Miss Thorns foot slipped out of the foot rest twice in the run home and believe that this was due to the sulky seat shifting. A fine of $150.00 was imposed in this instance. |
