An information was filed following the running of race two, alleging a breach of the Pushout Rule, 869 (4), (6), (b), & (c). The defendant was Mrs S Fenning and the information stated that Mrs Fenning breached the pushout rule forcing , Bellam's Last Play , (B Hill) to race wider on the track when she improved outwards to three wide with approximately1300 meters to run.

Mrs Fenning admitted the breach and was not present at the hearing of this information.

Mr. Muirhead showed the video of this incident and this clearly showed Mrs Fenning coming out and forcing Bellam's Last Play to race wider on the track with about 1300 meters left to run in this race.

Mr. Muirhead made submissions on penalty and recommended a fine of $200.00 in this instance.

Mr. Muirhead produced the driving record of Mrs Fenning and advised the committee that Mrs Fenning had just resumed driving following a suspension for incompetent driving.

The judicial Committee requested the registrar to ask Mrs Fenning to attend this hearing however Mrs Fenning had left the course by the time this information was presented to the Judicial Committee.

Decision And Reasons.

This judicial Committee has taken into account the frank admission of this breach of the rules by Mrs Fenning. In deciding on penalty in this instance we have taken into consideration the following factors.

  1. The movement outwards was undertaken without looking, no consideration of other horses or drivers in the race,
  2. --
  3. Blatant, Pushout action for no purpose, bordering on incompetent driving.
  4. --
  5. Bellam's Last Play was forced over extra ground as a result of this Push Out and lost the race by a half head. Bellam's last Play was the race favorite.
  6. --
  7. Mrs Fenning received her licence back on the 10th June 2005 after a six week suspension.

Given all of the above factors this Judicial Committee imposes a fine of $300.00 in this instance.
