The protest is not contested and is therefore upheld. It is ordered that PAY ME OVERS is relegated from 5th place to 6th place and MONET GRACE is accordingly promoted to 5th place.

The amended placings are now :

1st - (1) STRAWBERRY STRIDE

2nd - (2) LADY MADONNA

3rd - (4) CRYSTAL SPARKLES

4th - (5) OPOUTAMA

5th - (6) MONET GRACE

6th - (7) PAY ME OVERS

It is ordered that stakes be paid in accordance with the amended placings.

Facts:

Following the running of the IRT MOBILE PACE, an Information Instigating a Protest was lodged by Stipendiary Steward, Mr JM Muirhead against the 5th placing of PAY ME OVERS on the grounds that it locked wheels at about the 100 metres mark with the 6th placed MONET GRACE impeding the progress of that horse.

Mr SJ Reid the Trainer and part Owner of PAY ME OVERS was not present at the Hearing but he endorsed the Information with the words " I do not contest the Protest "

Rule 869(4) provides that no horse or its horseman shall do anything during a race which is likely to interfere with any other horse or its progress.

Rule 869(A) is the Protest Rule.

Mr Muirhead demonstrated the incident by use of the race films and showed where at about the 100 metres mark PAY ME OVERS drifted inwards and locked wheels with MONET GRACE. The wheels remained locked together for some distance and MONET GRACE was unable to progress.

Submissions for Decision:

Mr Muirhead submitted that as a result of the locking of wheels the progress of MONET GRACE was impeded and therefore PAY ME OVERS should be relegated behind that horse.
